Terms & Conditions for the Refer and Earn Campaign

  1. Introduction 
    1. The Refer and Earn Campaign (“the Campaign”) is being run by Mukuru Africa (Pty) Ltd (Company Registration number 2013/003424/07) (“Mukuru”) from 22 August 2023 and until such time that Mukuru ends the Campaign (“the Campaign Period”) subject to these specific terms and conditions and the general terms and conditions for Campaigns which can be found at www.mukuru.com (“Competition Ts & Cs”).
    2. By entering the Campaign, you confirm that you have read and agree to be legally bound by the Competition Ts & Cs.

  2. Campaign Information and Conditions:  
    1. In order to enter or participate in the Campaign you must be a registered Mukuru Customer and abide by all terms and conditions.
    2. During the Campaign Period, you may refer friends or family who are not already existing Mukuru Customers, to sign up to Mukuru via WhatsApp, USSD or the Mukuru App. In order to qualify you must follow the Refer and Earn steps on Mukuru’s Whatsapp, USSD or App sign-up function.
    3. By participating in this Campaign you confirm to Mukuru that you have the consent of the friend of family member to refer them to Mukuru.
    4. If a number has already been referred, successfully or not, by one Customer, another Customer will not be able to refer that number as well, under the terms of this Campaign.  Each cell number may only be referred once under these Ts & Cs.
    5. You may refer an unlimited number of cell numbers during the Campaign Period
    6. You can only refer by using a South African registered mobile number and the friend or family member’s mobile number must be registered in South Africa.
    7. If a referred person signs up with Mukuru using an agent or through any other means which are not considered Self Help Channels, the Customer who referred that individual to Mukuru will not be entitled to any Reward and the referral will not fall under the terms of this Campaign.
    8. A successful referral is when the referred person signs up with Mukuru using Self Help Channels and creates his/her first order of a minimum of R400 using the Mukuru Service and pays for the order, all during the Campaign Period (“Successful Referral”).
    9. Customers who fulfil the requirements of clause 2.1 -2.8 above will be referred to as “Qualifying Customers” for the purposes of the Campaign.
  3. The Reward 
    1.  For each Successful Referral the Qualifying Customer will receive R30 (Thirty Rand) airtime on their phone (the “Reward”).   
  4. Collecting your Reward  
    1. The Reward will be sent directly to the Qualifying Customer’s cell phone immediately (but not later than 24 (twenty-four) hours) after a Successful Referral. 
    2. In order to receive your Reward: 
      1. Your cell number must be with a South African mobile operator; and
      2. You must have a pay-as-you-go line or top-up contract with your mobile service operator. 
    3. Mukuru cannot be held liable for any failure to deliver the airtime which is attributable to technical failures outside of Mukuru’s control or because of a Qualifying Participant’s Mobile Operating Network rejecting the airtime load as a result of the Qualifying Participant’s particular mobile plan (for example an annual contract plan). 
    4. If airtime is not received, a Qualifying Participant can send an email to [email protected] but Mukuru cannot guarantee that airtime will be successfully loaded where there are factors outside of Mukuru’s control (such as a load rejection by a third party Mobile Operator).
    5. If the Reward cannot be transferred to a Qualifying Customer within 7 (seven) days because the Qualifying Customer does not meet the requirements of clause 4.2 above, or because of no fault of Mukuru, then the Reward will be forfeited.
  5. General  
    1. Please Note:  Mukuru may end this Campaign or vary the terms of this Campaign at any time without any liability to any person involved directly or indirectly in the Campaign.
    2. Mukuru employees will not be allowed to enter the Campaign.
    3. Mukuru reserves the right to ask for additional Know Your Customer (KYC) documents of anyone partaking in the Refer and Earn Campaign to comply with our KYC obligations and protect against fraud.
    4. Mukuru reserves the right to cancel or reject the referral to a friend for any legitimate reason at its discretion and in particular if:
      1. Mukuru suspects that the Refer and Earn Campaign has been abused in any way;
      2. you open more than one Mukuru account or spawning multiple fake accounts; 
      3. Mukuru has any reason to believe that you are inviting current Mukuru Customers to register new accounts;
      4. for any reason that raises concerns of illegal activities;
      5. or for any other reason that raises concerns of suspicious behaviour which is not in accordance with the spirit of the Refer and Earn Campaign.
    5. Mukuru reserves the right to suspend accounts of Mukuru Customers if it has any reason to believe or suspect that the Refer and Earn Campaign is being abused.
    6. If for any reason, the Campaign cannot run as planned because of any technical failures, unauthorised intervention, computer virus, mobile network failure, tampering, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Campaign, we reserve the right to cancel, terminate, modify, suspend or cancel the Campaign and/or to disqualify any individual who (whether directly or indirectly) causes (or has caused) the problem.
    7. The Reward is not transferable for cash or otherwise.
    8. Mukuru cannot be held liable for any loss, expense or damage to any person participating in the Campaign.
    9. A failure by Mukuru to enforce any one of the terms and conditions in any instance(s) will not give rise to any claim or right of action by any Qualifying Customer. If Mukuru does not enforce a provision, this will not mean that Mukuru has given up on or lost any rights.
    10. Mukuru will not assume any liability to any participant, or Qualifying Customer in connection with or arising out of the Campaign however it is caused, including for any costs, expenses, forfeited rewards, prizes, damages and other liabilities
    11. These Campaign Terms and Conditions are governed by the laws of South Africa.
